The State Pollution Control Board commonly called as SPCB, manages activities for preventing pollution and protecting the environment. SPCBs are established according to the provisions of the Water Prevention and Control Act of 1974. In order to protect and preserve the environment and check on environmental degradation, multiple rules and regulations are formed to manage different types of wastes, etc. Their work is limited to state hence their scope of work is limited to a state. The only primary requirement to obtain a NOC is CTE (Consent To Establish) towards an industry, plant or processing unit in compliance with SPCB/PCC. With reference towards the concurrent list that contains the subject matter of environment, the state can come up with their consent and prescribe standard operating procedures which can further put restrictions upon the setup of an industry in that particular area. The consent has a validity period of 1 to 5 years depending upon the category which has to be renewed further. This is all done with respect towards the safety and concern of the environment.

Once the industry is established and ready to operate at that stage it needs to get this NOC certification. All such industries must have this form of Consent to operate in order to operate legally in India.

The unit will require NOC for operation and an inspection if conducted by the SPCBs of the facility which is done by the inspection officer and will prepare a report for the same. The renewal application must be made 30 days prior to the expiry of the previous NOC followed by the submission made above. The procedure for inspection will be taken up by the concerned officer only then the renewal will be made towards the NOC. The renewal fees for the NOC will be similar to taking a new NOC.

Reasonable variations can be made with reference to Section 27 of the Water Act, 1974 which is done by the State Board. Even the SPCB can refuse to give its consent followed by the issuance of directions under Section 33 of the Water Act, 1974 which will require the closure and prohibition of the regulation operations of the industry and cease of electricity by SPCB.
The SPCB can further cancel the grant under Section 21 of the Air Act prior to the period of expiry only if the conditions for the grant were not fulfilled and there shall be a fair opportunity given to be heard towards the concerned entity for the cancellation.

The former industrial plants fall under two categories depending on the validity period for a Consent to Operate form (under the Air Act 1981 and Water Act 1974). They are:
