According to the prevailing regulations, obtaining a Consent to Establish (CTE) or a No Objection Certificate is mandatory for all types of industries, with a focus on environmental protection. A CTE serves as an authorization certificate issued by the Uttar Pradesh Pollution Control Board (UPPCB) prior to the initiation of any business activities. It is essential for every Project Proponent to secure the CTE from the State Pollution Control Board as a compliance requirement. The application must be submitted following the established procedure, accompanied by the requisite application fee and subject to inspection. This document guarantees that the enterprise adheres to the stipulations outlined in the certificate.
The established Unit must secure a No Objection Certificate from the State Pollution Control Board (SPCB) to commence operations for the project or unit within the relevant State. The application for Consent to Operate necessitates the completion of a distinct form, accompanied by the requisite application fee and supporting documents, contingent upon the accuracy of the submitted application.
Consent to Establish (CTE) for the Red, Orange, and Green categories is valid for a duration of one year or until the Project is completed and installed. Consent to Operate (CTO) for the Red and Orange categories is issued for a period of five years. The Green Category Consent may be granted for a maximum of ten years, while industries in the White Categories may receive consent for a term of up to seven years. All industries are required to submit an application for the renewal of their respective Consents upon expiration. Should there be any changes to a Project, it must secure Fresh Consent from the State Pollution Control Board.
Entities that transgress environmental regulations may encounter action from either the Pollution Control Committee or the State Pollution Control Board. Those involved in the project could land in jail for no longer than three months while facing fines between Rs 10.000 and 1% of its total amount. The board will try to enforce its regulations if it determines that agencies are acting illegally and are without the necessary approvals from the right authorities. If consent was gained in an unethical way, the board will also intervene.
