Aluminium dross is alumina containing aluminium and aluoxides which are formed during aluminium processing; that is sewing. Aluminium is produced industrially by the Bayer’s process and it comprises of metallic aluminium, aluminium oxide and the impurities. Although it is rich in valuable aluminium it is harmful material that needs proper handing and recycling equipment. Due to globalization and need to conduct businesses effectively and competitively and the aim to do so without wasting too much of resources, importation of aluminium dross has become important.
It may be noted that recently of Government of India, an import window has been provided for aluminium dross which has provided a big leap towards a resource efficient economy. In the strategic push for enhancing the country’s competency as a manufacturing hub, lowering reliance on raw materials and sustainability, this is not a new direction.
To import aluminium dross and other related materials in India following permission and approval were mandatory which are administered and regulated by various statutory authorities and boards this include Ministry of Environment, Forest, and Climate Change (MoEFCC), Central Pollution Control Board, an organization under MoEFCC that provides technical assistance, implementing the regulation as well as submitting guidelines for pollution control, Directorate General of Foreign Trade (DGFT) This is part of the Ministry of Commerce and Industry, responsible for regulating imports and exports in India.
The import of the Aluminium Scrap is governed by Rule 13(2) of the Hazardous waste (Management, Handling & Transboundary Movement) Rules, 2016 issued by Central Pollution Control Board, Ministry of Environment, Forest & Climate Change, Govemment of India.
In Part B of the list of other wastes applicable for import and export:
B1100 includes "Metal bearing wastes arising from melting, smelting and refining of metals", which lists: "- Aluminium skimmings (or skims) excluding salt slag" This suggests that aluminum skimmings or skims (which are types of dross) are allowed for import, but salt slag is excluded.
In Part D of the list of wastes applicable for import and export without permission from the Ministry of Environment, Forest and Climate Change:
B1010 includes "Aluminium scrap**" in the list of metal and metal-alloy wastes in metallic, non-dispersible form.
For importing aluminium dross, the following are required:
Aluminium dross is classified as "other waste" in Part D of Schedule III, which means it can be imported with proper documentation and permissions, unlike hazardous wastes which are more strictly regulated or prohibited.
The import of aluminium dross would be subject to verification by Customs authorities based on these documents.
Prior to clearing of consignment of wastes listed in Part D of Schedule III, the Custom authorities shall verify the documents as given in column (3) of Schedule VII.
The Port and Customs authorities shall ensure that shipment is accompanied with the movement document as given in Form 6 and the test report of analysis of the waste, consignment, wherever applicable, from a laboratory accredited or recognised by the exporting country. In case of any doubt, the customs may verify the analysis.
"Import permitted in the country to the actual user or to the trader on behalf of the actual users authorised by SPCB on one time basis and subject to verification of documents specified in Schedule VIII of these rules by the Custom Authority."
A Aluminium Dross Import License once issued is valid for 18 months and thereafter required to be renewal. But a annually compliance report is to be submitted as per Hazardous waste (Management, Handling & Transboundary Movement) Rules, 2016 every year.
