EPR Plastic Waste Annual Compliance
EPR (Extended Producer Responsibility) Plastic Waste Annual Compliance is a program aimed at ensuring that, by a requisite producer, engage in the management and disposal of the plastics waste that accrue from their products. In this system, the companies have made an annual goal to collect, recycle and process the plastic waste for eradicating pollution in the environment. It requires “disclosure of the amount of pet plastic in the market, assurance of ‘proper’ disposal of the plastic wastes and sponsorship of waste management initiatives.” On its own, the increased thinking is intended to encourage readier reception of the concept of waste management and to subvert the interactions of the municipalities with the unwanted plastic waste to extend it to the producers. These laws attract penalties, and restriction in the operations of business ventures whenever and wherever regulations are violated.
Various standards are involved in the implementation of the laws regulating plastic wastes depending on the source of wastes. The SPCB and the PCC have the legal right in the certification of manufacturers, processing and disposal of plastic waste from States and Union Territories. The Secretary in charge of Urban Development is held responsible for the disposal of wastes from plastic carry bags, sheets and multiple layer packaging in the urban zones. In the rural territories the responsibility of waste management is in the hands of Gram Panchayats; the authorities can apply to the District Magistrate/Deputy Commissioner for help if necessary. The SPCB and the PCC are to prepare Extended Producer Responsibility compliance report to the CPCB and the State Monitoring Committee there is a compliance report for the recyclers in addition to the end of life disposal and required to submit such report by 31st July of the succeeding financial year.
Definition of important terms as per plastic waste management rules 2016
“plastic” means material which contains as an essential ingredient a high polymer such as polyethylene terephthalate, high density polyethylene, Vinyl, low density polyethylene, polypropylene, polystyrene resins, multi-materials like acrylonitrile butadiene styrene, polyphenylene oxide, polycarbonate, Polybutylene terephthalate;
“plastic waste” means any plastic discarded after use or after their intended use is over;
“extended producer’s responsibility” means the responsibility of a producer for the environmentally sound management of the product until the end of its life;
“producer” means persons engaged in manufacture or import of carry bags or multilayered packaging or plastic sheets or like, and includes industries or individuals using plastic sheets or like or covers made of plastic sheets or multi-layered packaging for packaging or wrapping the commodity;
“importer” means a person who imports or intends to import and holds an Importer - Exporter Code number, unless otherwise specifically exempted.
“brand owner” means a person or company who sells any commodity under a registered brand label;
“Plastic Waste Processors” means recyclers and entities engaged in using plastic for energy (waste to energy) and converting it to oil (waste to oil).

1- How much plastic has been recycled.
2- The quantity allocated to waste-to-energy or co-processing facilities.
3- The procedures and volume of plastics gathered by the company or through Producer Responsibility Organizations (PROs).
Step 1: Register on the Central Pollution Control Board (CPCB) or the State Pollution Control Board (SPCB) EPR portal online.
Step 2: Some mandatory information includes company name, type of producer (manufacturer, brand owner, importer), contact information, and production capability.
Step 3: Submit documents
Step 4: If required, affix the registration fee alongside and post the form.
Step 5: After the registration is approved you will receive your own registration number, which will be needed for further actions towards compliance.
Step 1: Dispose of the different kinds of plastic waste produced or put into the marketplace, based on the classification provided in the Plastic Waste Management Rules 2016 and changes made thereto.
Step 2: The plastic could be classified under the following types:
Rigid packaging products (bottles, containers, pipes).
Stretchable plastics (plastic bags and the packaging films inclusive).
Food packing material, laminated plastics, packaging plastics, personal care products packing plastics
Step 3: Evaluate the quantity (in tons or kg) of each variety of plastic launched into the market. This information is highly useful while determining your specific EPR amount.
Step 1: Calculate the total plastic waste introduced by the company during the reporting period (e.g., the previous financial year).
Step 2: Determine the EPR target based on this amount. The government provides guidelines on the percentage of waste that needs to be recycled or managed for each type of plastic (rigid, flexible, multilayered).
Step 3: Fulfill the liability through:
Own waste management system: Develop a collection, transport and recycling of plastics to foster proper management of wastes.
Collaboration with PROs (Producer Responsibility Organizations): Intend to work closely with agencies who collect and recycle the plastics to enhance their collection.
Plastic Credit Mechanism: For some specified targets, companies can buy plastic credits from accredited waste recycling companies.
Step 4: Ensure proper documentation and maintain records of the collection, processing, and disposal of plastic waste.
Step 1: Log in to the EPR portal using your credentials.
Step 2: Download the prescribed form for submitting the annual return (Form I for brand owners, Form II for producers/importers).
Step 3: Provide details such as:
Quantity of plastic introduced into the market in the previous financial year (segregated by rigid, flexible, and multilayered plastic)
Quantity of plastic waste collected, processed, and recycled or disposed of.
Proof of recycling or waste management activities undertaken (e.g., certificates from recyclers or waste processors)
Step 4: Submit the return online before the deadline (typically April 30th for the previous financial year).
Step 5: Ensure a copy of the return is sent to the SPCB/PCC, and maintain records for audit purposes.
