The Battery Waste Management Rules 2022 guidelines specify the following requirements in the context of Imports:

• The rules identify “Producer” as the individuals who import batteries as well as any equipment that has batteries installed in it (Res 3:1 (u)).
• If any manufacturer of batteries or importer of batteries is engaged in the manufacture of batteries or import of batteries they shall register as a “Producer” with the Central Pollution Control Board through a centralized online portal for Form 1 (A) (Rule 4 (4)).
• The Central Pollution Control Board shall register the Producer under section 5 the Environment (Protection) Act, 1986 in Form 1(B) (Rule 11(1)). Such registration is made to be valid for 5 years (Rule 11(4)).
• As per the registered Producer they have to submit the Extended Producer Responsibility in form 1C with detail of like import and manufacturing of quantity and type of battery etc in every fiscal year (Rule 4(7),(8)).
• Manufacturers and importers must comply with target schemes for collection and recycling/refurbishment, depending on the number of batteries produced and imported according to Schedule II of the rules.
• Original equipment/Patent producers are required to submit Forms 3 and 4 to CPCB and the concerned State Pollution Control Boards by 30th June following the year and contain information about waste batteries collected and recycled or refurbished (Rule 4(11)).
• Law allows suspension/cancellation of registration and environmental compensation by CPCB in case of non-compliance provided in Rules 11(7), and 13.
• Among regulations Advisory on Specific Chemicals such as; There are restrictions on metals such as mercury, cadmium, etc., that can be imported in batteries (Schedule I).
• It can also be noted that imported batteries should also be labeled in accordance with the labeling requirements set out in Schedule I.

Procedure for Registration for Lithium-Ion Scrap Battery Import License in Madhya Pradesh

As per The Batteries (Management and Handling) Rules, 2001 following are the procedure for Registration-

• For a period of five years importers must register with the Central Pollution Control Board using Form I. There is a cancellation provision for failure to collect the required number of used batteries in accordance with the rules non-submission of timely half-yearly returns to the State Pollution Control Boards with a copy to the Central Pollution Control Board and renewal of the registration based on compliance status provided however that the importers registration will not be revoked unless he has been afforded a reasonable opportunity to hear the matter.
• Any orders issued by the Central Pollution Control Boards Member-Secretary or any other officer the board designates to be suspended canceled or refused registration are subject to appeal.
• Within thirty days of the orders passing date an appeal must be filed in writing include a copy of the order being appealed against and within time.

Responsibilities of Importers in Madhya Pradesh

As per The Batteries (Management and Handling) Rules, 2001 following are the following are the Responsibilities of Importers-

• Except for batteries supplied to original equipment manufacturers and large consumers make sure that all used batteries are returned in compliance with the timetable that is laid out for new battery sales.
• Make sure that the collected used batteries match the type and specifications of the batteries that are sold new.
• Using Form-I submit a half-yearly report of sales and buyback to the State Board by June 30 and December 31 of each year.
• Create collection centers at different locations to receive used batteries from dealers or customers either on your own or in cooperation with others.
• Assure that only authorized recyclers receive the used batteries that are collected.
• Make the necessary arrangements with dealers to ensure that used batteries are transported from collection centers to authorized recyclers locations safely.
• Verify that the environment is not harmed in any way while in transit.
• Promote public awareness of the risks associated with lead the need for consumers to return used batteries only to dealers or approved collection locations and the addresses of these establishments through publications posters ads and other media.

• Report any violations by dealers to the State Board or the Ministry of Environment & Forests.
• Confirm that new batteries are only sold to registered dealers.
