Plastic waste Authorization is a permission granted which allows entities registered to transport, store, recycle or collect plastic waste in India. As plastic wastes promotes serious health issues to humans and adversely effects environment as it contains toxic chemicals, pollutants. So in order to avoid harmful effects of plastic it is necessary to proper management of plastics wastes.
Plastic waste management is a grave environmental concern globally. More plastic products on the market combined with ineffective recycling and disposal practices have resulted in massive ecological pollution endangering terrestrial ecosystems marine life and human health. Only when robust policies are put in place new technologies are developed and all stakeholders are actively involved will it be possible to manage plastic waste effectively. To ensure that plastics are sustainably managed it requires authorization and regulation.
Advantages of Plastic Waste Management Authorization-
- Technological Innovations- Plastic waste management can be enhanced through technological innovations. Advanced recycling technologies, biodegradable plastics, waste-to-energy conversion methods etc., are areas where technology can have a great impact.
- Advanced Recycling Technologies- Recycling practices that were used traditionally often could not work well mainly because of contamination or degradation resulting in poor quality plastics. For instance, chemical recycling is an example of advanced recycling technologies that can convert mixed- contaminated-plastics back into their original monomers hence leading to production of high-quality recycled plastics. There are already companies such as Eastman and BASF who have started developing these technologies on a large scale.
- Stakeholder Participation- To effectively manage plastic waste requires the involvement of all stakeholders ranging from governments, corporations to end-consumers.
- Government Initiatives- Governments play a key role in policy formulation, financial provision and increasing public awareness. Actions like banning the use of plastics, return deposit schemes as well as mass education can result into significant decrease in plastic wastes.
- Corporate Responsibility- There is an increased realization that businesses also have some responsibilities towards controlling plastic waste. Several companies are adopting environmental practices such as reduced packaging volumes, use of recycled materials or investing in recycling facilities. Some corporate collaborations like Alliance to End Plastic Waste contribute towards global solutions too.
- Consumer Engagement- Consumers can be part of managing plastic wastes by cutting down their consumption of disposable plastics through participating in recycling programs, and supporting products made from recycled materials. Public awareness campaigns and education are essential for encouraging responsible consumer behavior.
Eligibility criteria for Plastic Waste Management Authorization
The type and extent of an organizations plastic waste activities determine the requirements for authorization which vary. Nonetheless the following are some of the common prerequisites:
- Having a current certificate of registration or incorporation.
- Verification of the ownership or lease of the space used for the activities involving plastic waste.
- Having the tools and machinery required for the gathering storing moving processing or recycling of waste plastic.
- Creating an environmental management plan that includes waste disposal techniques pollution control strategies health and safety guidelines etc.
- Getting approval from the SPCB or UTPCC to establish and operate.
- Following the guidelines and standards for managing plastic waste that have been established by the MoEFCC and the CPCB.
- Upkeep of logs and records detailing the amount of plastic waste produced handled or recycled by the company.
- Submission of yearly reports to the CPCB or UTPCC and SPCB.
What are the documents needed to obtain a Plastic Waste Authorization?
It may differ based on the state and the particular plastic waste activities carried out by the organization. But there are a few standard documents that are usually needed such as:
- The organizations registration or certificate of incorporation.
- Evidence of ownership or a lease for the space used for the activities involving plastic waste.
- Details about the tools and machinery used to gather store transport process or recycle waste made of plastic.
- A plan for environmental management should include strategies for reducing pollution disposing of waste maintaining health and safety and other pertinent issues.
- Assent to form and function under the auspices of the Urban and Town Planning and Construction Committee (UTPCC) or the State Pollution Control Board (SPCB).
- Aadhaar cards PAN cards and GST certificates along with the details and supporting documentation of the authorized individual who will be signing them are all required.
- Details about the goods such as model numbers and import background.
- Specifics of any arrangement or contract if any with a recycler. Note that these are only general requirements for precise and current information it is best to refer to the states particular regulations and guidelines.
What are the steps required to be fulfilled for getting Plastic Waste Management Authorization?
The steps involved in obtaining authorization for plastic waste are as follows:
- The applicant must fill out an online application and submit the required documents which includes the environmental management plan the certificate of incorporation proof of ownership or a lease for the property information about the machinery and equipment and permission to establish and operate.
- To determine the suitability and capacity of the applicants premises the SPCB or UTPCC will review and inspect the application and accompanying documentation.
- The SPCB or UTPCC will either issue the authorization or reject the application within 120 days of receiving the completed application.
- By submitting a renewal application at least 120 days prior to the authorizations expiration date it is possible to extend its validity for an extra five years after it is first issued.
- The authorization holder must abide by all terms and conditions stated in the authorization which may include filing yearly returns keeping accurate records and registers and abiding by standards and best practices.
How long the validity of Authorization and when to apply for renewal?
The authorization for plastic waste is good for five years from the date it was issued. At least 120 days before it expires the authorizations holder may request that it be renewed. Along with updated documents and proof that the terms and conditions of the authorization have been followed the renewal application must be submitted online. Within 120 days of receiving the completed application the SPCB or UTPCC will decide whether to approve the renewal or reject the application. Additionally, the renewed authorization will remain valid for five years after it is issued.
Cancellation suspension or revocation of Plastic Waste Management Authorization-
The SPCB or UTPCC may cancel suspend or revoke the authorization for plastic waste in the following situations:
- If the terms and conditions of the authorization are not met.
- Inadequate submission of the renewal application or the annual reports.
- Giving out fictitious or deceptive information or documentation.
- Caused or about cause harm to human health or the environment.
- Breaking any of the 2016 and 2018 Plastic Waste Management Rules or any other applicable law.
The SPCB or UTPCC will notify the authorization holder of any violations found above. The holder will have a chance to address the notice and make their case for why the authorization shouldn’t be withdrawn suspended or cancelled. The SPCB or UTPCC will decide whether to cancel suspend or revoke the authorization after taking the authorization holders response into account. Within 15 days following the final decision the SPCB or UTPCC and the CPCB will both be informed of this decision to the authorization holder.
What are the compulsory Compliance?
The following compulsory compliance measures must be followed by the holder of the plastic waste authorization:
- For all plastic waste that they generate process or recycle the authorization holder is required to keep thorough records and registers. This contains information about the amount category source destination and mode of transportation among other things.
- By January 31st of every year the authorization holder is required to submit annual returns to the Central Pollution Control Board (CPCB) the Union Territory Pollution Control Committee (UTPCC) and the State Pollution Control Board (SPCB). The plastic waste that they produced processed or recycled during the preceding calendar year should be fully disclosed in these returns.
- The CPCB and the Ministry of Environment Forests and Climate Change (MoEFCC) have established standards and guidelines for the management of plastic waste which the authorization holder is required to follow. This entails abiding by the rules regarding the gathering storing moving processing recycling and getting rid of plastic waste.
- Prioritizing the health and safety of employees and the public when engaging in plastic waste activities is the responsibility of the authorization holder. This entails offering personal protective equipment holding educational sessions and setting up routine health examinations.
- The authorization holder must implement extended producer responsibility set up effective systems for collection and channelization and encourage the segregation and transportation of plastic waste among other best practices and standards for managing plastic waste.
- Throughout all plastic waste operations, the authorization holder is required to maintain environmental protection and pollution control. This include cutting down on waste production avoiding the release of dangerous materials and optimizing resource recovery.
