Procedure for getting Import of Refurbished Electronics Product License in India
They include Import of refurbished electronic products which are outlined in the current E-Waste Management Rules of 2022. Undefined
- Registration: The refurbisher has to obtain an ID and password to get itself registered on the online portal created by CPCB under ‘Refurbisher’ option as per the provisions of Rule 4.
- Product Standards: Under the provision of Rule 7(3), the refurbished equipment should fall under the Compulsory Registration Scheme of the Ministry of Electronics and Information Technology and conform to the guidelines formulated by the Bureau of Indian Standards strictly for the refurbished items.
- Authorization: Once registered, the refurbisher requires obtaining consent from the State Pollution Control Board or Pollution Control Committee based on CPCB guidelines [Rule 7].
- E-Waste Collection: The refurbisher should be able to have a system of handling e-waste which was produced throughout the process of refurbishing and directing it to a registered recycler [Rule 7(2)].
- Compliance Reporting: The refurbisher is under obligation to electronically submit annual and quarterly reports on the portal disclosing information about their operations and the compliance with the rules [Rule 7(4)].
- Import Regulations: Thus, there are some general provisions regarding import of refurbished products which lays down beneath the relevant laws such as the Customs Act, 1962 and the Indian Ports Act, 1908. In addition, port/customs authorities may crosscheck the imports against the refurbisher’s registration and the authorizations.
Suspension and cancellation of Refurbisher Authorization
Where the SPCB feels that the Refurbisher authorization has not complied with any of the conditions given under the authorization or any other provisions of the legislative enactments concerning this issue, then the SPCB has the right to cancel or suspend such authorization. This will be done after affording the affected party a fair opportunity to present his/her/their case and after a proper recording of the justifications to be given for the cause of the action. As for the period of suspension or cancellation, the SPCB is entitled to decide the time for this matter in the name of the public. The CPCB is also needed to ensure that the notifying authority is informed of the cancellation within ten days after the cancellation of the authorization by the SPCB.
If there is suspension or cancellation of refurbisher authorization the SPCB/c CPCB shall issue guidelines on how individuals will be handling the storage and management of e-waste which should be followed by the parties in question.
Appeal
- Any person or the appellant who is dissatisfied with the order of suspension or cancellation or refusal of registration or its renewal passed in accordance with the provisions of this rule by the Central Pollution Control Board may, within a period of thirty days from the date on which the order is communicated to him prefer an appeal to the Additional Secretary or Joint Secretary Ministry of Environment, Forest and Climate Change duly nominated by the Central Government in this regard.
- The Appellate Authority shall be bound to entertain the appeal if the same is filed beyond the said period of thirty days and if the Appellate Authority is of the opinion that the appellant had sufficient reasons that prevented him or her from filing the appeal within the said period of thirty days.
Responsibilities of the refurbisher
The refurbisher's responsibilities are as follows:
- The refurbisher must register on the portal.
- They are required to collect e-waste generated during the refurbishing process and hand it over to a registered recycler. Additionally, they must upload information about the waste on the portal.
- It is their duty to ensure that the refurbished equipment complies with the Compulsory Registration Scheme of the Ministry of Electronics and Information Technology and the Standards of the Bureau of Indian Standards specifically designed for this purpose.
- The refurbisher must file annual and quarterly returns on the portal, using the prescribed form, before the end of the month following the respective quarter or year for which the return is being filed.
The fundamental necessities for the refurbishment process are as follows:
- Firstly, a designated area with sufficient space to store all e-waste separately from the products and utilities is required.
- Secondly, a closed space resembling a small factory room is essential.
- The third essential requirement includes the necessary materials, machinery, and equipment for repairing the refurbished items.
- Additionally, a network of suppliers is needed to provide an adequate supply of refurbished materials that require repair.
- Land and labor are also essential requirements, the extent of which depends on the scale of the business.
Additional Guidelines for Refurbisher-
- The e-waste shall also be allowed for refurbishing and refurbisher shall have to get registered on the portal and based on the data provided, refurbishing certificate shall be generated in favour of a registered refurbisher in the format laid down by it in this regard.
- On production of the refurbishing certificates purchased from the registered refurbishers, the extended producer responsibility of the producers shall be deferred by the duration as laid down by the Central Pollution Control Board for the corresponding quantity of e-waste and shall be added to the extended producer responsibility of the producer upon expiry of the extended life of the refurbished product.
- To incentivise refurbishing, only 75 per cent of the deferred quantity shall be added to the extended producer responsibility of the producer for recycling upon expiry of the extended life of the refurbished product.
